Illinois Adult Day Services and Home Care: Two Licenses, Two Rulebooks

In Illinois, adult day services and non-medical home care are licensed by two different agencies — and getting the sequence right is what gets you open.

Adult day services: a site-specific license

Adult day services are certified by the Illinois Department on Aging under the Community Care Program. The license is tied to a specific building that must clear local zoning, a floor plan review, and a fire inspection. Community Care Program rules also require 40 square feet of activity area per participant — excluding exits, offices, storage, and restrooms — so your real capacity is lower than your square footage suggests.

Non-medical home care: no facility required

Non-medical home care is a different path. Illinois licenses it as a Home Services Agency through the Department of Public Health under 210 ILCS 55. There's no facility, zoning, or fire inspection — but you still need business registration and a complete policy set. You can run both under one entity, but each has its own requirements and Medicaid enrollment timeline.
