Oklahoma - Personal Assistance Services — Licensing, Medicaid Enrollment and Startup Requirements

In Oklahoma, Personal Care services are funded through the Medicaid State Plan and the ADvantage Waiver program, and are licensed by the Oklahoma State Department of Health (OSDH) Home Services Division as a Home Care Agency. The Oklahoma Health Care Authority (OHCA) and the Department of Human Services (OKDHS) ADvantage Administration jointly oversee the certification and enrollment of these agencies.

To become an approved Personal Care Agency provider, an applicant must first obtain a Home Care Agency license from OSDH, which requires an initial on-site survey. Once licensed, the agency must meet OKDHS certification standards and execute a SoonerCare (Medicaid) contract through the OHCA Provider Enrollment portal.

1. Service Definition and Scope

State Plan Personal Care (SPPC) and ADvantage Waiver Personal Care services provide assistance to eligible SoonerCare members in carrying out activities of daily living (ADLs) such as bathing, grooming, and toileting.

Services are provided in the member's own home or other limited living arrangements. The focus of the service is the eligible member and their needs, requiring the provider to participate in interdisciplinary care planning and perform supervisory home visits by a licensed nurse at least once every six months.

2. Regulatory and Oversight Agencies

The Oklahoma State Department of Health (OSDH) Home Services Division is responsible for licensing Home Care Agencies. The Oklahoma Health Care Authority (OHCA) is the single state Medicaid agency that administers SoonerCare and handles provider enrollment.

The Department of Human Services (OKDHS) ADvantage Administration certifies qualified personal care provider agencies and facilitates the execution of SoonerCare contracts on OHCA's behalf.

3. Gatekeeping Prerequisites: Who Can Even Apply

Before applying for Medicaid enrollment as a Personal Care Agency, an entity must first obtain a Home Care Agency license from the OSDH. There is no Certificate of Need (CON) requirement for personal care agencies in Oklahoma.

Providers must also meet certification standards identified by OKDHS ADvantage Administration before a SoonerCare contract can be executed. Individual personal care providers may only be utilized in geographic areas where there are insufficient agency providers.

4. Licensure and Certification Requirements

Agencies must submit an Application for License to Operate a Home Care Agency (ODH-757) to the OSDH Home Services Division. The application process includes an initial on-site survey to determine if the agency meets minimum requirements.

If deficiencies are cited during the initial survey, the agency must provide a written plan of correction. The agency must also comply with OAC 310:662 requirements for home care agencies.

5. Medicaid Provider Enrollment

Once licensed and certified, the agency must enroll through the OHCA Provider Enrollment portal to obtain a SoonerCare contract. The ADvantage Administration facilitates the execution of these contracts on OHCA's behalf.

OHCA conducts on-site screening visits for providers not already screened by another state or federal agency. These visits may be unannounced and non-cooperation can affect enrollment.

6. Staffing, Training and Background Checks

Personal Care Assistants (PCAs) or supportive home assistants must complete agency-based training taught by a registered nurse. They must demonstrate competence through testing by an OSDH-approved independent entity.

Agencies must verify that employees have no pending notations on the nurse aide or community service worker registries. Criminal history background checks are required under the Home Care Act.

7. Documentation, Policies and Records

Agencies must develop a written training plan covering observation, reporting, and documentation of client status. They must also maintain a written grievance process that includes a designated contact person.

Comprehensive professional documentation is required if an agency seeks to disenroll a member due to physical abuse, threats of harm, or refusal of care.

8. Billing, Rates and Claims

Payment for SPPC services is based on the service type and the number of authorized service units in the member's individual plan. Reimbursement is determined according to established SoonerCare rates.

Providers are responsible for the accuracy and integrity of all submitted claims. Any false claims or concealment of material facts may be prosecuted.

9. Approval Sequence and Timeline

The approval sequence begins with submitting the ODH-757 application to OSDH. OSDH will work with the applicant to facilitate a complete application before scheduling the initial on-site survey.

After obtaining the Home Care Agency license, the provider must meet OKDHS certification standards and complete the OHCA SoonerCare enrollment process, which may include an unannounced on-site screening visit.

10. Common Denials and Survey Findings

Applications may be summarily dismissed by OSDH if they are incomplete and fail to meet requirements for an initial survey. During the survey, deficiencies are cited if minimum requirements are not met.

At the enrollment stage, non-cooperation with OHCA representatives during on-site screening visits can negatively affect or deny enrollment.
