Approval requires passing a two-step process: first obtaining DPSQA certification by demonstrating compliance with Division of Aging, Adult and Behavioral Health Services (DAABHS) Nutrition Services Program Policy Number 206, and second, submitting Form DMS-652 to the Medicaid Provider Enrollment Unit managed by Gainwell Technologies. Commercial kitchen infrastructure is a strict prerequisite, as Arkansas prohibits billing Medicaid for meals prepared in private residential kitchens.

1. Service Definition and Scope

Under the ARChoices in Homecare waiver, Home-Delivered Meals provide nutritious food to individuals unable to prepare their own meals. The service includes both hot meals delivered daily and frozen meals provided for weekends or extended coverage.

The service is strictly regulated to prevent duplication of benefits. For example, meals cannot be billed on the same day a participant receives more than 20 units (5 hours) of adult day services, adult day health services, or facility-based respite care.

2. Regulatory and Oversight Agencies

Oversight is divided between the Department of Human Services (DHS) and the Department of Health (ADH). DHS manages the waiver and provider certification, while ADH ensures food safety and kitchen sanitation.

Medicaid enrollment and claims processing are handled by Gainwell Technologies, the state's fiscal agent for the Medicaid Management Information System (MMIS).

3. Gatekeeping Prerequisites: Who Can Even Apply

Arkansas does not require a Certificate of Need (CON) or a competitive Request for Proposals (RFP) to become a Home-Delivered Meals provider. The network is open to any entity that can meet the structural and nutritional prerequisites.

The primary structural precondition is commercial kitchen infrastructure and professional dietary oversight. An applicant cannot even submit a certification request without prior kitchen approval and menu sign-off.

4. Licensure and Certification Requirements

Arkansas does not issue a distinct "license" for meal delivery; instead, providers must obtain Home Delivered Meals (HDM) Certification from DPSQA. This certification verifies that the provider meets all Centers for Medicare and Medicaid Services (CMS) and state criteria for the ARChoices waiver.

Certification requires proof of local permits, food handler cards, and compliance with safe food transportation laws. Intermediate delivery sources (e.g., couriers or sub-contracted drivers) must also meet federal, state, and local food transportation laws.

5. Medicaid Provider Enrollment

After obtaining DPSQA certification, providers must enroll in Arkansas Medicaid by submitting the Provider Application (Form DMS-652) and a Medicaid Provider Contract. Certification by DPSQA does not automatically guarantee Medicaid enrollment.

Applications are processed by the Medicaid Provider Enrollment Unit, operated by Gainwell Technologies. Providers are assigned a unique Medicaid number linked to their tax identification number and National Provider Identifier (NPI), if applicable.

6. Staffing, Training and Background Checks

Arkansas mandates strict background checks for all personnel involved in the Home-Delivered Meals program. This applies to all owners, principals, employees, and contract staff.

Staff handling food must also maintain appropriate health and safety credentials, including food handler cards as required by local jurisdictions.

7. Documentation, Policies and Records

Providers must maintain comprehensive records demonstrating compliance with DAABHS Nutrition Services Program Policy Number 206 and Medicaid provider manual requirements. This includes documentation of meal delivery and participant receipt.

Records must be made available to DHS audit staff or the PCSP/CC Nurse upon request to verify service delivery and ensure no duplication of services occurs.

8. Billing, Rates and Claims

Billing for Home-Delivered Meals is processed through the Arkansas Medicaid MMIS portal managed by Gainwell Technologies. Providers must bill according to the specific procedure codes and modifiers outlined in the ARChoices waiver manual.

Claims are subject to strict auditing for duplication. If a participant receives day services or respite services on the same day, the time of day services are received is reviewed by DHS audit staff to determine if the meal claim is valid.

9. Approval Sequence and Timeline

The approval process is sequential and cannot be expedited by submitting Medicaid enrollment forms before certification is complete. Providers must first secure their physical infrastructure and local approvals.

Once the kitchen is approved and menus are verified, the provider applies to DPSQA for certification. Only after receiving the official DPSQA certification can the provider submit Form DMS-652 to Gainwell Technologies.

10. Common Denials and Survey Findings

Applications are frequently delayed or denied when providers attempt to use unapproved residential kitchens or fail to provide the required Registered Dietitian nutrient analysis. DPSQA will not issue certification without these foundational elements.

During audits, providers often face recoupments for billing meals on days when the participant was attending an adult day center or receiving facility-based respite for more than 5 hours, violating the duplication of services rule.
