Alabama - Day Habilitation Services — Licensing, Medicaid Enrollment and Startup Requirements

The Alabama Department of Mental Health (ADMH) and the Alabama Medicaid Agency jointly oversee Day Habilitation Services funded through the Home and Community-Based Waiver for Persons with Intellectual Disabilities (ID Waiver). Governed by Alabama Administrative Code Chapter 560-X-35, this service provides regularly scheduled non-residential activities limited to a maximum of five hours per day.

Prospective providers must complete a mandatory two-phase Prospective Provider Orientation through Relias and secure ADMH certification before the Alabama Medicaid Agency will accept a provider enrollment application. Effective October 31, 2025, all certification applications must be submitted through the newly automated Alabama Certification Automation Program (ACAP) database.

1. Service Definition and Scope

Day Habilitation Services in Alabama involve the provision of regularly scheduled activities in non-residential settings, separate from the member's residence. The focus is on enabling the member to attain and maintain their maximum potential through assistance with acquisition, retention, or improvement in self-help, socialization, and adaptive skills.

These services must be coordinated with any needed therapies in the member's person-centered services and support plan. They are expected to be furnished in a variety of community settings and must fully comply with the HCBS Settings Rule.

2. Regulatory and Oversight Agencies

Day Habilitation Services operate under a dual-oversight model in Alabama. The Alabama Department of Mental Health (ADMH) acts as the operating agency responsible for provider certification and quality assurance.

The Alabama Medicaid Agency serves as the single state agency, handling final provider enrollment, claims processing, and overall waiver administration.

3. Gatekeeping Prerequisites: Who Can Even Apply

Alabama enforces strict pre-application requirements that block entities from submitting a certification application until specific training and system registrations are complete. Completing these steps does not guarantee certification or funding.

The state requires prospective providers to utilize specific training platforms and, as of late 2025, a mandatory automated database for all submissions.

4. Licensure and Certification Requirements

Because Alabama does not issue a traditional "facility license" for Day Habilitation, providers must instead obtain ADMH Certification. This process demonstrates compliance with the standards outlined in the Alabama Administrative Code for developmental disability services.

Programs unable to demonstrate the ability to meet these standards during the multi-phase application and review process will not be certified.

5. Medicaid Provider Enrollment

Once ADMH certification is secured, the agency must enroll as a billing provider with the Alabama Medicaid Agency. This is conducted entirely online through the Medicaid Provider Secure Web Portal.

Providers must agree to Medicaid Participation Requirements and ensure their systems meet the portal's technical specifications to avoid losing application progress.

6. Staffing, Training and Background Checks

Day Habilitation providers must maintain sufficient, qualified staff to meet the acuity needs of the waiver participants. Staffing ratios are strictly tied to the participant's assessed tier.

Direct care staff, referred to as Habilitation Aides, must undergo specific state-approved training regimens administered by the provider agency.

7. Documentation, Policies and Records

Providers must maintain rigorous documentation to justify Medicaid reimbursement and prove ongoing compliance with ADMH standards. This includes daily service logs and individualized planning documents.

All services must be directly tied to the goals outlined in the participant's formal care plan.

8. Billing, Rates and Claims

Reimbursement for Day Habilitation Services under the ID Waiver is tiered based on the assessed needs of the participants. Claims are submitted electronically to the Alabama Medicaid MMIS.

Providers must ensure they do not duplicate billing for services covered under other Medicaid authorities.

9. Approval Sequence and Timeline

Becoming a Day Habilitation provider in Alabama is a sequential process that can take a considerable amount of time. Steps cannot be taken out of order.

Prospective providers should account for training time, policy development, ADMH review, and Medicaid enrollment processing.

10. Common Denials and Survey Findings

Applications and ongoing certifications are frequently delayed or denied due to failure to meet structural or documentation standards. ADMH strictly enforces the HCBS Settings Rule.

Technical errors during the Medicaid enrollment phase also cause significant delays for newly certified providers.
